CLIENT SERVICE AGREEMENT

Client Service Agreement

We do forward all of our clients a client service agreement when fowarding you an invoice. The Client Service Agreement sets out the terms and conditions for payment of fees, factors beyond our control, and copyright of images.

Please note, the payment of your deposit demonstrates an acceptance of the terms of this agreement.

Fees

A booking fee (generally taken in the form of a 50% deposit towards your session) will be required to confirm your session booking. This will be advised and discussed prior to your booking. Special limited number sessions such as Christmas shoots will require payment in full when booking.

In circumstances where payment has not been received within 48 hours of booking a session, Jolly Snaps Kids’ Photography (JSKP) reserves the right to cancel the booking without notice.

The booking fee is not refundable but may be transferable.

In the case of cancellations, JSKP requests a minimum of 24 hours’ notice to cancel a booked session where a deposit has been paid. In these circumstances the deposit may be transferred to another booking session.

In the case where a session is required to be rescheduled due to weather conditions the client will be given the option to reschedule the session to an agreeable time.

When a period of less than 24 hours’ notice is provided, JSKP reserves the right to withhold the deposit paid by the client.

Full fee for services is payable on the day of the photography session, and photos will be withheld until full payment is received. Yes, we now have Eftpos facilities available!

Where full payment for a session has not been received within 30 days of the completion of a session, the photo image files held by JSKP will be deleted, and any deposit paid will be forfeited.

The booking of and any additional costs incurred for booking venues, photography locations, additional props are the responsibility of the clients and may be invoiced unless paid for separately. This will be agreed upon between JSKP and the client before any additional costs will be incurred.

Factors beyond our control

Jolly Snaps Kids Photography will endeavor to cater for clients requests and needs. There are however circumstances which are beyond the control of the photographer that may affect the quality and outcome of the photographic session.

These factors include, however are not limited to weather conditions, individual personalities and attention span of children during photoshoots and make up or spray tans. Clients need to be aware that as these factors are beyond the control of the photographer.

Jolly Snaps Kids' Photography is not responsible for the behaviour of children that may adversely affect the outcome of the session. This includes children who may be unwell or tired, or not wish to be photographed on the day.

Other elements beyond JSKP control include faulty material, equipment failure, loss of photos/digital files during processing and developing, industrial disputes, civil disturbances, or weather conditions which may inhibit or prevent the Studio completing in whole or in part this assignment. In this case JSKP shall not be liable for its complete performance of the assignment. It is agreed that the liability of the JSKP shall be limited to be a refund of any money paid under this agreement which shall be in full & final satisfaction of any damage or loss suffered.

The Copyright of all images remains with Jolly Snaps Kids Photography. The images are for the personal use of the client who purchases the photos, and are not to be provided to third parties for commercial purposes and/or uses without permission from Jolly Snaps Kids Photography. Images provided on USB or disc may be printed for personal use by the client. Images will be kept for a period of 5 years by JSKP.

JSKP may use the images for promotional or advertising purposes on Facebook, the website or on other promotional material. Please advise us if you do not wish us to use your photos in this way.
